Prepared to Comply? ARP & Cobra Discussion

The American Rescue Plan Act (the “ARP”) was signed into law on March 11, 2021, and the law requires a 100% subsidy of COBRA premiums for the period April 1, 2021, through September 30, 2021 (for medical, Rx, dental, vision, and HRA plans). ARP applies to certain eligible employees that were involuntarily terminated during the COVID-19 pandemic and provides a special enrollment period for previously terminated employees. ARP has substantial new compliance obligations for both entities subject to federal COBRA and small group health insurance plans subject to mini-COBRA (state continuation) laws.
